As i said before, i regard a 2009 GOTY, a game that i've played and finished in 2009 for the 1st time no matter when it was released.
I don't care about release dates. I care about when i experienced it. If it was in 2009 then it going to be part of the 2009 top 5.
Take for example Dead Space. The game was released in 2008. I played it in 2009. It is not in my top 5 2008 GOTY but in 2009 GOTY.
My GOTY is based on my experience and emotions during the game. Not the hype, knowledge, info, reviews read and score received by others.
You are not considering Batman: AA at all because you simply haven't played it yet. What happens if you play it in 2010 and it really captivates you? You will simply include it in your top 5 2010 list.
I have a similar problem as i tend to play most of my games some time after they are released. For example Far Cry 2 would have been my number 2 for 2008 but i played in 2009.
If something like this occurs i just revise my previous lists.
